Terms of service

These are the rules for using merry-bells.com and the songs you buy here. We have tried to write them in plain English rather than the usual fog.
The short version: what you buy is yours to play, at home or with the group you belong to, for as long as you like. Please do not re-upload it or hand your account around. Everything else is detail.
1.Who you are dealing with

By buying something or creating an account you are agreeing to these terms. If you do not agree with them, please do not use the site.
2.Your account
You need to be 18 or older to open an account. Give us a real email address — it is how we send your receipt and how you get back in if you forget your password.
Your account is yours alone. You are responsible for what happens under it, so keep the password to yourself. Tell us right away if you think someone else has gotten in.
3.Orders, prices and tax
All prices are in US dollars. Sales tax is added at checkout where it applies. Prices can change, but never for an order you have already placed.
Very occasionally a price is wrong — a typo, a decimal in the wrong place. If that happens we will cancel the order and refund you in full rather than quietly charge you the higher amount. We will not hold you to an obvious mistake, and we would ask you not to hold us to one either.
4.What you can do with the songs
When you buy a song, a collection, or the all-access pass, you get a personal license to it. It does not expire and you do not have to renew anything.
Yes, please:
- Play it at home, as often as you like, with family and friends.
- Use it in a classroom, a church or congregation, a care home, a scout troop, a library group or a community choir you are part of.
- Put it on the big screen. Casting to a TV is exactly what it is for.
- Keep playing it for as long as you have an account with us.
Please do not:
- Upload it anywhere — YouTube, Facebook, a school website, a shared drive.
- Share your account login, or give copies to people outside your household or group.
- Sell it, rent it, or bundle it into something you sell.
- Charge people admission specifically to watch the videos, or broadcast them publicly.
- Strip out or obscure the identifying mark on the video.
That mark is a quiet one in the corner and it is tied to the account that bought the video. We are not trying to make anyone uncomfortable — it exists so that if a file turns up somewhere it should not be, we can tell where it came from.
If a purchase is refunded or charged back, the license for it ends and the songs leave your library. That is the only circumstance in which we take something back.
5.Bell sets and DVDs
Physical items ship from Utah, usually within two business days. Shipping is shown at checkout before you pay, and is never more than $10 an order. Full details are on the shipping and returns page, which forms part of these terms.
6.Refunds
Physical items can come back within 30 days in resalable condition and we will refund them.
Digital purchases are non-refundable once you have played or downloaded them, for the obvious reason that we cannot take them back. If something is genuinely broken — a video that will not play, a file that will not open — that is not a refund question, it is our problem to fix. Email us.
7.Keeping the library available
We intend for the songs you have bought to stay available indefinitely, and we will not remove things casually.
Two honest caveats. Streaming depends on services we do not control, so we cannot promise the site is never down. And very occasionally a title may have to be withdrawn from sale for reasons outside our hands — a licensing question, most likely. If that ever affects something you already bought, we will tell you in advance and refund that purchase.
8.Who owns what
The videos, animations, arrangements, recordings, artwork, the Merry Bells name and this website are ours. Buying a song gives you the license in section 4, not ownership of the material.
The underlying songs are a separate matter. Most are traditional or in the public domain and belong to nobody. Where a song is still under copyright, that copyright belongs to its owner, not to us — what we own is our particular arrangement and recording of it.
9.Fair use of the site
Please do not try to break into the site, scrape it, hammer it with automated requests, or work around the limits on how many devices can stream at once. We may suspend an account that does. If we ever suspend yours we will tell you why, and if we got it wrong we will put it right.
10.The legal bit
The site and the songs are provided as they are. We do not promise the site will be uninterrupted or error-free, and to the extent the law allows we exclude the implied warranties that would otherwise apply.
Our total liability to you is limited to what you have paid us in the twelve months before the claim. We are not liable for indirect or consequential losses. Nothing here limits liability that cannot be limited by law, and some states do not allow these exclusions, in which case they simply do not apply to you.
11.Governing law
These terms are governed by the laws of the State of Utah, and any dispute belongs in the courts of Utah.
12.Changes and contact
If we change these terms we will update the date at the top, and we will email account holders if the change is significant. Changes are not retroactive — the terms you agreed to when you bought something are the ones that apply to it.
